Terms of Use
1. About these terms
Soundcheck (“Soundcheck,” “we,” “us”) is an independent project operated by David Scott DiPerna at trysoundcheck.com. These terms govern your use of it. You accept them when you create an account and select “I agree.” If you don’t agree, please don’t use Soundcheck.
Our Privacy Policy explains what information we collect and how we handle it, and is part of these terms.
2. Who can use Soundcheck
You must be at least 18 years old. You sign in with a Google account, and you’re responsible for activity under your account. One account per person — please don’t share access.
3. What Soundcheck does — and doesn’t
Soundcheck uses AI models to predict how a person you describe might react to a message you’re thinking of sending.
- Its output is a simulation, not a fact or a guarantee. A persona is an approximation built from what you tell us. It isn’t the real person, and it can be wrong about them.
- It isn’t professional advice — legal, employment, medical, financial, or otherwise.
- You decide what to send, and you’re responsible for it.
4. Your content
“Your content” means everything you enter into Soundcheck — descriptions, interview answers, pasted material, messages and goals you test — and the output generated for you.
- You keep ownership of your content.
- You give us permission to store, process, and transmit your content — including to the service providers listed in our Privacy Policy — only as needed to operate Soundcheck for you.
- You’re responsible for your content, and you confirm you have the right to provide it. In particular, if you enter material from work, it’s up to you to make sure that’s allowed by your employer’s policies and any confidentiality obligations you have. We can’t make that judgment for you.
- Your personas and content are private to your account. We don’t share them with other users.
5. Acceptable use
You agree not to use Soundcheck to:
- break the law or infringe anyone’s rights;
- harass, intimidate, shame, or threaten anyone;
- impersonate a real person, or present Soundcheck’s output as something a real person actually said or wrote;
- create content meant to mislead others about who wrote it;
- monitor, profile, or rate people in order to make decisions about them — for example about hiring, discipline, housing, or credit;
- get around usage limits, access controls, or security measures, including by creating additional accounts;
- access Soundcheck by automated means — bots, scripts, or scraping — other than through the app as provided;
- probe, attack, or reverse-engineer the service, or interfere with anyone else’s use of it;
- resell Soundcheck or offer it to others as a service.
Several of these come from the usage policies of the AI providers Soundcheck relies on. We pass them on because your use of Soundcheck reaches those providers through our accounts with them.
6. Usage limits
To keep Soundcheck available and its costs manageable, we limit how much any account can use it — for example, how many personas you can keep and how many tests you can run in a day. Current limits are shown in the app and may change.
7. Emails from us
By creating an account, you agree that we may email you at the address on your Google account about your account and the service — for example, important changes, security notices, or replies to your support requests. We won’t send you marketing or newsletters unless you separately opt in.
8. Services we rely on
Soundcheck depends on third-party services, including AI model providers, hosting, and a database host; our Privacy Policy lists them. We aren’t responsible for their availability, and parts of Soundcheck may change or stop working if they do.
9. Suspension, termination, and deleting your account
- You can stop using Soundcheck and delete your account at any time.
- We may suspend or terminate your account at our discretion, including if we believe you’ve violated these terms, or to protect Soundcheck, other people, or our providers. Where practical, we’ll tell you why.
- If we terminate your account for violating these terms, we may keep its data as described in our Privacy Policy.
- We may change, pause, or discontinue Soundcheck at any time.
10. No warranty
Soundcheck is provided free of charge, “as is” and “as available,” without warranties of any kind, whether express or implied — including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don’t promise that Soundcheck will be uninterrupted or error-free, or that its predictions will be accurate.
11. Limitation of liability
To the fullest extent permitted by law, we won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or opportunities, arising from your use of Soundcheck — including decisions you make based on its output. Our total liability for any claim relating to Soundcheck is limited to US $50. Some jurisdictions don’t allow these limits, so they may not apply to you.
12. Indemnity
You agree to cover any claims, losses, and costs — including reasonable legal fees — brought against us by others that arise from your content or from your violation of these terms.
13. Changes to these terms
We may update these terms. When we do, the version and date at the top will change. If a change is material, we’ll ask you to agree again before you continue using Soundcheck.
14. Governing law
These terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Michigan, and you consent to their jurisdiction. Mandatory consumer-protection laws where you live still apply.
